Refund and Cancellation Policy
A. Policy Overview
Introduction
Consumers are entitled to certain rights regarding refunds and cancellations under the following conditions. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activity:
Right of Cancellation and Refund
You have the right to cancel this contract within 14 days.
The cancellation period is 14 days from the day on which you or a third party designated by you, who is not the carrier, took possession of the last goods.
Notwithstanding the above, the cancellation period is fourteen days in the case of a contract for the regular delivery of goods over a fixed period, starting from the day on which you or a third party designated by you, who is not the carrier, took possession of the first goods.
To exercise your right of cancellation and refund, you must inform us (Avunex Portal, Al Barsha 1, Dubai, UAE, Tel.: +971585935004, Email: business@avunexmedia.com) of your decision to cancel this contract by means of a clear statement (e.g., a letter sent by post or email). You may use the attached model cancellation form, but it is not obligatory.
To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right of cancellation before the cancellation period has expired.
Effects of Cancellation
If you cancel this contract, we shall reimburse to you all payments received from you, including delivery costs (except for additional costs arising from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we received the notice of your cancellation from this contract. We will carry out the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in no case will you incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is earlier.
You shall send back or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you communicate your cancellation from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.
You bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.
Exclusions or Limitations
The right of cancellation and refund does not apply in the following cases:
- For contracts for the supply of sealed goods that are not suitable for return due to health protection or hygiene reasons if their seal was removed after delivery.
- For consumers who, at the time of concluding the contract, do not belong to a Member State of the European Union and whose sole residence and delivery address are outside the European Union at the time of concluding the contract.
General Information
1) Please avoid damage and contamination of the goods. Please return the goods in original packaging with all accessories and all packaging components to us. If necessary, use a protective outer packaging. If you no longer have the original packaging, please ensure sufficient protection against transport damage with suitable packaging.
2) Please do not send the goods back to us freight collect (unpaid).
3) Please note that the above points 1-2 are not prerequisites for the effective exercise of the right of cancellation and refund.
4) The customer is responsible for the return shipping.
